If EPA give you what you perceive to be Lemons . . . Make Lemonade!

EPA and LemonadeNo one is seeing the billions of dollars in potential relief EPA is offering States.

On Monday EPA recognized in the final ozone rule that climate change is increasing ozone:

“[C]limate change has the potential to increase average summertime O3 concentrations by as much as 1–5 ppb by 2030” (80 Fed. Reg. 65292 at 65300)

  • 81% of CO2 comes from outside the U.S.
  • EPA said that States are not responsible for reducing background pollution
  • States therefore potentially don’t need to offset 4.05 ppb (i.e. 81% of 5 ppb) with additional local VOC and NOx controls

EPA is telling you States that you are not responsible for offsetting the world’s pollution in your SIPs . . . so stop it.  You’ve got enough of your own pollution to deal with.

The world is changing.  We must change with it.  Time to simplify and transform the Clean Air Act to better prepare ourselves for the problems and opportunities of a 21st century world (ex. “The Clean Air and Climate Change Act of 2015”).  We can make it happen.
