California Valley Finding: 22% of Ozone Coming from Asia

California and Foreign PollutionSlide from Valley’s recent decision to request re-designation and drop 185 fees.  Mind-blowing that over 22% of peak ozone is coming from Asia. 

And Valley you are stuck.  Unlike Eastern States—there ain’t no “good neighbor” provision in the Clean Air Act to get emission reductions from your neighbors.  You’ve got to offset the foreign pollution or demonstrate it ain’t yours (see 42 U.S.C. §§ 7407(a) and 7509).   And even if you appropriately convince EPA it ain’t yours—you are still in nonattainment and are now in a situation where no one is responsible for addressing 22% of the pollution impacting your lungs (see 78 Fed. Reg. at 34205 and 42 U.S.C. § 7509).

The world is changing.  We must change with it.  Time to transform the SIP process.  We can make it happen.
